Frivolous Lawsuits
You might have heard from various news sources about our postings on Facebook about Frivolous Lawsuits.
If you want to see the juicy stuff, just go to our Facebook Page and review our notes.
This was our original posting:
We usually keep quiet about these things and as our fans, you have supported us in the past, however it seems that a time has come when we need to make a statement about frivolous lawsuits. Just to give you a quick glimpse into what we go through at the City Museum, a couple of years ago our rock fell 4 feet. The next day we had over 12 people call and tell us they were injured when the rock fell. To investigate these claims, we reviewed the video of the rock falling and we posted the video clearly showing that there was no one next to the rock when it fell on our website. When this was brought to several of the caller’s attention they either hung up or changed their stories. We find it interesting that 75% of all injures involving lawsuits are adults. Adults who run and jump into a ball pit that says both “Do not jump” and “For 6 and under”. Adults who go down a slide no less than six seconds after another adult when the sign says “One at a time” and “Wait until bottom is clear.” (These are actual things we are dealing with now.) Adults who know better or adults that don't know their limitations. We pride ourselves at the City Museum on not having tons of signs telling people where to go, what to do, or how to do it, so when there is a sign, we'd hope people take notice and act accordingly.
We understand that by creating a place where kids and adults can run, jump, and play, that there is a risk for injury. We are constantly doing everything we can to mitigate that risk all the while trying to protect the integrity of the museum. What exhausts us are the people that see the museum as an opportunity to perpetuate insurance fraud. We would like to let everyone know that there are cameras in the museum and people are watching to make sure that everyone is safe. In the same vein, if you say you were injured, we'll be able to see that too. If you are injured in the museum, please find one of our staff members and report it as soon as possible (NOT 5 days later when you return from your trip). We will do everything we can to assist you and make sure your injuries are tended to in a timely manner. If you call and say your are injured and we come to find out it wasn't here or it didn't happen (or, as frequently happens, you were NEVER here), please know that this is illegal and the proper authorities will be notified. We might even post some video of you having a great time and NOT getting injured on our website.
We understand that it's a litigious world out there and that these things happen, but this goes against everything we believe in at the City Museum. We like to think that people coming in our doors understand that they need to watch their kids, and that if you haven't jumped since Bo and Luke Duke were all the rage, then maybe you should take it easy your first few visits. We appreciate our guests more than we can ever say, we just ask that you exercise your common sense, be a good person, and don't try to rip us off. Following up on these claims is a waste of time and resources and results in higher admission costs, and then everyone is a loser.
Thanks,
CM
